High-Risk & Regulated Industries

Businesses operating in highly regulated industries often face additional challenges when communicating with their customers.

Industries such as cannabis, CBD, gambling, financial services, tobacco, vaping, and alcohol may be subject to strict requirements around advertising, customer consent, age verification, data privacy, and messaging content.

LoopMessage provides an omnichannel messaging API that can help eligible businesses build direct, personalized conversations with their customers through supported messaging channels, including iMessage, SMS/RCS, and WhatsApp.

With support for two-way messaging, rich media, API integrations, and configurable data retention, businesses can create customer communication workflows that feel more like natural conversations than traditional one-way notifications.

The key advantage is a conversation-first approach: customers can initiate contact, ask questions, and receive personalized responses instead of being treated as recipients of generic messaging campaigns.

However, availability depends on the industry, jurisdiction, intended content, messaging channel, and applicable platform policies. End-to-end encryption does not exempt businesses from these requirements.

1. Who can benefit from conversational messaging?

LoopMessage may be useful for eligible businesses operating in industries with additional legal, regulatory, or platform-specific restrictions.

Cannabis, CBD, and Hemp

Cannabis-related businesses may need to communicate with customers about general inquiries, customer support, store operations, and other service-related matters.

Depending on applicable laws and channel policies, potential use cases include:

  • Responding to customer-initiated questions.
  • Providing general business information.
  • Handling customer service inquiries.
  • Supporting eligible, age-verified customers.
  • Managing permitted service-related communications.

Rules may differ significantly between cannabis, CBD, hemp-derived products, and non-intoxicating hemp goods. A product being legal in one jurisdiction does not automatically mean it is permitted on a particular messaging platform.

Promotional content or messages facilitating restricted product sales may be prohibited by the destination platform, even where local law permits the business to operate.

Gambling, Casinos, and Betting

Licensed gaming and betting operators often need to maintain communication with customers concerning account services and support requests.

Where permitted by law and the selected messaging channel, potential use cases include:

  • Customer-initiated support conversations.
  • Account assistance and general inquiries.
  • Service availability information.
  • Responsible-gaming support.
  • Permitted operational notifications.

For online gambling and betting, channel-specific restrictions may require additional authorization and proof of licensing.

Some messaging platforms restrict gambling-related messages even when the operator holds a valid license.

Payday Loans and Short-Term Lending

Financial services providers, including short-term lenders, operate under specific requirements related to consumer protection, privacy, and financial communications.

Where the messaging channel permits the business and its intended use case, conversational messaging may support:

  • Responses to customer service requests.
  • General application-status inquiries.
  • Assistance with account-access questions.
  • Customer-requested explanations of procedures.
  • Non-promotional service communications.

Businesses should avoid requesting sensitive financial credentials through ordinary messaging conversations and should use secure authenticated systems when discussing confidential account information.

Certain messaging platforms explicitly prohibit payday lending, debt collection, or related business models. These restrictions cannot be bypassed by using a different API integration.

Tobacco, Alcohol, and Vaping

Businesses dealing with age-restricted products may need customer support channels for existing customers.

Depending on the product category and applicable policies, eligible uses might include:

  • General customer support.
  • Store or service information.
  • Customer-requested assistance.
  • Permitted account or operational notifications.
  • Responses concerning product documentation or safety information.

Tobacco and vaping promotions are prohibited on certain business messaging platforms, while alcohol-related communication may be restricted by geography and recipient age.

Businesses must verify channel eligibility before implementing these workflows.

2. Why conversational messaging is different

Traditional business messaging often follows a one-way model:

Business → Message → Customer

The recipient receives a notification, announcement, or promotional message, but the interaction may end there.

LoopMessage is designed around two-way communication:

Customer → Conversation → Personalized response → Continued interaction

This distinction can provide several benefits for businesses with approved messaging use cases.

Encourage meaningful customer engagement

A conversation creates an opportunity for the customer to ask questions, clarify information, and receive relevant assistance.

Instead of automatically sending several generic messages, your application can respond to what the customer actually says.

For example, a customer may contact your business with a question, receive a helpful answer, and ask for additional information.

This can feel more natural than a sequence of unrelated outbound notifications.

Build recognizable customer relationships

When customers interact with a consistent sender identity, they can recognize the business in future conversations.

You can configure a sender name and photo, and share a contact card when supported.

A recognizable identity helps customers understand who they are communicating with.

Make communication more relevant

You can use information from your CRM and existing customer relationship to provide contextually relevant responses.

For example, if a customer asks about an existing support request, your backend can identify the request and provide an appropriate response without requiring the customer to repeat information unnecessarily.

Support interactive customer experiences

Depending on the messaging channel, LoopMessage supports features such as:

  • Two-way text conversations.
  • Media attachments.
  • Message reactions.
  • Replies and message threads.
  • Webhooks for incoming messages.
  • API-based automation.

These capabilities allow businesses to build more interactive customer support experiences, subject to the relevant platform and content restrictions.

3. Privacy and end-to-end encryption

Privacy is particularly important for businesses operating in regulated industries.

Some supported messaging channels provide end-to-end encryption, protecting message contents during eligible communications.

iMessage

iMessage uses end-to-end encryption for messages exchanged through Apple’s iMessage service.

This protects message content during transmission between eligible endpoints.

However, Apple maintains rules concerning commercial use, unwanted messaging, and abuse. Encryption does not guarantee acceptance of a commercial messaging use case.

RCS

RCS offers capabilities such as rich media, delivery information, and interactive messaging.

End-to-end encryption is available in supported configurations, including eligible conversations between Google Messages users.

Not every RCS conversation is end-to-end encrypted. Encryption availability depends on the participating applications, devices, and providers.

WhatsApp

WhatsApp uses encryption technology to protect eligible messages.

The exact privacy and encryption properties of business conversations depend on the business configuration and whether Meta or other service providers are involved in hosting or processing messages.

WhatsApp also maintains specific business messaging restrictions, including restrictions on regulated industries.

What encryption does—and does not—mean

Encryption can help protect message content during transport, but it does not mean that:

  • Every supported messaging channel is always end-to-end encrypted.
  • Your CRM, API backend, or stored conversation history is automatically end-to-end encrypted.
  • Messaging providers cannot enforce their policies.
  • All regulated content is permitted.
  • Legal requirements for marketing, privacy, or customer consent no longer apply.

Businesses remain responsible for securing their own systems and ensuring that the intended communications are authorized.

Important: LoopMessage should not be used to circumvent platform restrictions, industry regulations, or carrier policies.

4. Let customers initiate conversations

For many businesses, an effective starting point is to let customers contact the business first.

LoopMessage offers several ways to implement customer-initiated messaging.

Option 1: LoopMessage Sign-up Forms

Our Sign-up Forms allow you to collect customer information and direct users to a supported messaging application.

After completing the form, the customer selects an available messaging channel and sends a pre-filled message to your sender.

LoopMessage can then associate the inbound message with the submitted form data.

This helps establish a clear customer-initiated interaction.

For regulated businesses, additional controls may be necessary before enabling the form, including eligibility screening, age verification, geographic restrictions, and appropriate consent notices.

Option 2: Opt-in API

If you already have a website, customer portal, or custom registration flow, you can integrate the Opt-in API.

This allows you to generate unique messaging links and associate the completed opt-in with your customer records.

For example, an eligible customer could open a support conversation directly from your authenticated customer portal.

Your backend can then use the inbound webhook to identify the customer and continue the interaction.

Option 3: Existing forms and Init Conversation

LoopMessage also offers an Init Conversation feature for eligible senders and use cases.

However, initial outbound messages are subject to additional restrictions, including sending intervals, warm-up rules, reply-rate requirements, and content limitations.

The first message cannot contain promotional content, links, prices, or attachments.

Customer consent alone does not override industry-specific restrictions or make an otherwise prohibited message permissible.

For regulated industries, review the use case with LoopMessage Support before enabling proactive outbound messaging.

5. Build customer communication workflows

Once your business, recipient, intended content, and messaging channel are eligible, you can integrate LoopMessage into your existing customer service infrastructure.

A typical workflow might look like this:

  1. A customer visits your website or authenticated portal.
  2. Your application verifies any required age, geographic, or account eligibility conditions.
  3. The customer requests assistance or starts a permitted conversation through an available messaging channel.
  4. LoopMessage receives the inbound message and notifies your backend through a webhook.
  5. Your CRM or support system identifies the relevant customer record.
  6. Your backend or support representative sends a personalized response.
  7. The conversation continues based on the customer’s questions and the communications permitted for that channel.

This approach can be used with human support agents, CRM workflows, or automated assistants.

Example: Customer support

Customer: “Hi, I have a question about my existing account.”

Business: “Hi Alex! Thanks for reaching out. I’m Jordan from the support team. What can I help you with today?”

Customer: “I’d like to check the status of my request.”

Business: “Of course. For privacy, you can view the latest details in your secure account portal. Would you like help accessing it?”

This example illustrates a customer-initiated, service-oriented conversation without promoting a regulated product or disclosing confidential account details.

Example: Operational inquiry

Customer: “Hi! Are your business hours changing this weekend?”

Business: “Thanks for checking! Our customer support team will be available from 10 AM to 6 PM on Saturday. Is there anything else we can help you with?”

These examples illustrate conversation structure, not automatic approval for a particular business category or messaging channel.

6. Control how long LoopMessage stores your data

Regulated businesses may need additional control over how long customer information is retained.

LoopMessage provides a Data Retention feature that allows you to configure retention periods for:

  • Message history.
  • Webhook history.
  • API request history.

You can configure separate retention periods for each category, with a minimum of 1 day.

This allows organizations to align LoopMessage’s retained history more closely with internal data-retention policies.

For example, your organization might choose to keep API request logs for a shorter period than message history.

Important: Data Retention settings control the relevant records stored by LoopMessage. They do not automatically delete data held by messaging platforms, telecom carriers, recipient devices, external CRM systems, or your own storage providers.

Choose retention periods carefully. Extremely short retention settings may affect troubleshooting and features that rely on historical message information.

7. Store attachments in your own S3 bucket

LoopMessage also provides an S3 Bucket integration.

This feature allows you to store inbound message attachments in your own S3-compatible storage rather than relying on temporary attachment availability.

Supported storage services include Amazon S3, DigitalOcean Spaces, Cloudflare R2, and other S3-compatible providers.

Benefits include:

  • Greater control over where inbound attachments are stored.
  • The ability to apply your own storage access policies.
  • Integration with your existing data-management infrastructure.
  • Flexibility in defining retention and deletion policies for files in your bucket.

For sensitive files, use private storage and appropriate access controls.

The S3 integration does not automatically make your messaging workflow compliant with financial, privacy, or other industry-specific requirements.

8. Automate messaging with your CRM or backend

LoopMessage provides an API for building custom messaging integrations.

You can connect your own application, CRM, customer support platform, or automation infrastructure.

Potential capabilities include:

  • Receiving customer messages through webhooks.
  • Creating support tickets.
  • Matching incoming messages with customer records.
  • Routing conversations to support agents.
  • Generating relevant, permitted responses.
  • Managing contacts and opt-out preferences.
  • Tracking message statuses.

Use Deferred Messages for permitted follow-ups

The Deferred Messages feature can automatically queue messages affected by applicable sending intervals.

You can also define a custom sending schedule with specified weekdays, hours, and timezone.

For example, you can restrict eligible service follow-ups to your support team’s business hours.

Deferred Messages respects sending intervals; it does not grant permission to send prohibited content or override customer consent requirements.

9. Compliance considerations

Before using LoopMessage for a high-risk or regulated business, review the requirements of your industry, the jurisdictions involved, and each messaging platform.

Business eligibility

Some industries are restricted or prohibited on certain messaging channels.

A valid business license does not automatically authorize every type of messaging.

Age and location restrictions

Businesses selling age-restricted products or operating jurisdiction-specific services may need to verify customer age and location before enabling communications.

A regular opt-in form is not a substitute for legally required age or identity verification.

Obtain the appropriate permission for each intended type of communication.

Consent to receive customer support messages does not necessarily authorize unrelated promotional campaigns.

Honor opt-outs and maintain any required consent records.

Content restrictions

Marketing, transactional notifications, account support, and customer service may be treated differently by messaging platforms.

A service-related interaction may be permitted where promotional messaging is prohibited, but this must be confirmed for the particular channel and use case.

Messaging platform policies

Review the policies of each destination platform before launching:

Note that Google RCS for Business and consumer RCS messaging are different services and may have different rules.

High-risk use-case review

LoopMessage may require additional information about your business, intended messages, regulatory status, or technical configuration before approving a high-risk use case.

Some use cases may not be supported.

We recommend contacting LoopMessage Support before purchasing or configuring messaging infrastructure for a regulated industry.

10. Getting started

If you operate a high-risk or highly regulated business, the following approach can help you evaluate whether LoopMessage is appropriate.

Step 1: Define your use case

Determine whether you need customer support, account-related messaging, operational notifications, or another communication workflow.

Step 2: Confirm legal and platform eligibility

Review the regulations applicable to your business and recipients, as well as the policies for each intended messaging channel.

Step 3: Contact LoopMessage Support

Describe your industry, location, intended messaging channels, and the types of communications you plan to send.

Our team can review the technical requirements and determine whether the use case is supported.

Step 4: Configure your integration

Once the use case is approved, connect LoopMessage to your existing CRM, customer portal, or backend using the API.

Step 5: Configure privacy controls

Review Data Retention and S3 storage settings according to your organization’s security and data-management requirements.

Step 6: Launch customer conversations

Offer approved messaging entry points to eligible customers, handle inbound requests, and build interactive support experiences that respect consent, applicable regulations, and channel-specific restrictions.

Create more meaningful customer conversations

For businesses operating in highly regulated industries, communication is not just about sending messages. It is about establishing trust, providing relevant assistance, protecting customer information, and respecting the rules that apply to each interaction.

LoopMessage provides the infrastructure for building two-way messaging experiences, integrating with existing business systems, and controlling important aspects of your data-handling workflow.

When your business and use case are eligible, a conversation-first approach can help you create a more personal, interactive customer experience while maintaining the controls appropriate for your industry.
